April Fools – Here’s the Real Law in Florida

i get all the support 'cause you make all the money! It’s one of the oldest myths in the Florida divorce playbook:

“You make more money, so I automatically get all the child support!”

🎉 April Fools! 🎉 ¶ That’s not how it works. Not even close. ¶  ¶ In fact, Florida has a structured, formula-driven system for determining both child support and time-sharing, and it’s a lot more balanced than most pe ople think. ¶  ¶ Let’s break down a few common myths, and the truth behind them. ¶  ¶

 ¶  ¶

the parent who makes less always gets full custody🧨 MYTH #1: “The parent who makes less always gets full custody.”

REALITY:
Florida courts focus on the best interes ts of the child, not income. ¶ Custody, technically called time-sharing, is based on parenting ability, stability, and the child’s needs. Financials might impact support, but they don’t determine where the child lives.

🧨 MYTH #2: “I make more, so I automatically pay more.”

REALITY:
Child support in Florida uses something called the Income Shares Model. This estimates what both parents would have spent together on the child, then splits that cost proportionally based on income and time-sharing.

we have 50:50 time sharing, there’s no child support.🧨 MYTH #3: “If we have 50/50 time-sharing, there’s no child support.”

REALITY:
Not always. Even with 50/50 time-sharing, child support may still be owed, especially if there’s a big gap in income. It’s about fairness and ensuring your child’s needs are met in both homes.

🧨 MYTH #4: “I can avoid child support by not working.”

REALITY:
Nice try. Florida courts can impute income, meaning they’ll estimate what you could be making and base support on that. Voluntarily quitting or underemployment won’t help your case.

🧠 So What’s the Takeaway?

Child support and time -sharing in Florida aren’t about winning or losing; they’re about your child having stability, support, and a consistent life, no matter which home they’re in.

If you’re navigating custody or support, you deserve facts, not fiction.
